Software and diagnostic licence

Scope
This licence applies to Windows diagnostic batch files generated by admin-tools and to the related web application used by the customer and authorised end users.
Copyright
The web application, its design, source code, batch templates and texts and notices provided by admin-tools are protected by copyright unless they belong to third parties. Third-party rights remain unaffected. admin-tools.de is not affiliated with Microsoft, Windows or any other manufacturer.
Right of use
The customer receives a simple, non-exclusive right, limited to the period of permitted use, to use the generated batch file and related software for authorised technical diagnostic purposes. The right to use the software itself is not transferable to arbitrary third parties; the expressly permitted distribution of the generated batch file within the customer’s own organisation and as part of authorised IT services for clients remains unaffected.
Scope of the licence
The licence covers storing, running and evaluating the generated batch file within the intended technical process. It does not transfer ownership of the service, source code or underlying templates.
Internal use and IT services
Use and distribution of a generated batch file within the customer’s own organisation to authorised employees and other authorised end users is permitted. IT service providers may also use the batch file on their clients’ systems as part of their support services and distribute it to those clients’ authorised end users, provided they are authorised to perform the diagnosis. Recipients must be informed about its purpose, the checks performed and any transfer of the log; required data protection agreements remain a prerequisite.
Limits of the licence
Without an additional express agreement, the customer must not in particular sell the batch file as a standalone product, resell or sublicense the software or access to the service, provide admin-tools as a standalone competing service, publish the batch file as their own product, incorporate substantial parts into a competing product, remove copyright or licence notices, bypass protective measures, or use the application abusively or without authorisation. Automated use is prohibited in particular where it impairs the service, bypasses protective measures or falls outside the intended diagnostic purpose. Using a batch file for many authorised systems within the customer’s own organisation or those of supported clients remains permitted where technically and commercially provided for. Paid IT support services for authorised clients are also not excluded by these prohibitions; they do not grant any additional resale or sublicensing rights.
Legally permitted acts
Mandatory statutory rights remain unaffected. Legally permitted acts, including mandatory rights under copyright law, are not excluded generally by this licence. This applies only to the extent of the applicable statutory requirements.
Changes to the batch file
The customer may adapt the batch file for their own authorised diagnostic process provided that no protective measures are bypassed, notices removed or third-party rights infringed. For a modified batch file, the application cannot guarantee the intended assignment, processing or evaluation.
Third-party software and licences
The batch files use built-in Windows commands and, for some checks, PowerShell or .NET functions. These components are subject to the rights and licence terms of their respective providers. This licence grants no additional rights in Windows, PowerShell, .NET or other third-party software.
Reverse engineering
Reverse engineering, decompilation and disassembly are excluded only to the extent permitted by law. Mandatory statutory rights, including rights to achieve interoperability or examine a program within the legally permitted scope, remain unaffected.
Termination of the licence
The licence ends when the customer stops using the service, the account is effectively terminated or the customer materially breaches this licence. After termination, further execution and distribution must stop unless statutory rights or a new agreement provide otherwise. Diagnostic data lawfully collected already is handled under the applicable retention and deletion rules.
Liability
The provider is liable in accordance with statutory law. Liability for intent, gross negligence, damage to life, body or health, and mandatory statutory liability, in particular under product liability law, remains unaffected. In the event of a slightly negligent breach of essential contractual duties, liability is limited to foreseeable damage typically occurring. Otherwise, any exclusion of liability for slight negligence applies only to the extent legally permissible.
Responsibility for the diagnosis
The customer remains responsible for ensuring that the diagnosis is run only on systems for which there is appropriate authorisation to examine them. The customer is also responsible for selecting checks, authorised distribution of the file and using the results.
